1. GENERAL PROVISIONS

1.1 These General Terms and Conditions of Sale (hereinafter referred to as General Conditions) concern the regulation of the purchase of Products, made at a distance, means by telematic network, through the www.passion4dolls.com website (hereinafter referred to as the Website).

1.2 Owner of the Website is Passion4Dolls (hereinafter Passion4Dolls) with registered office in 95100 Catania CT, Tax Code and VAT Number: 05735530874.

1.3 All purchases of Products made through the Website (hereinafter, the Purchase Agreements) by the users who access it (hereinafter, the Customers) are governed by these General Conditions as well as by the Italian Consumer Code (Legislative Decree 206/2005), section Distance contracts (articles 50-67) and the Italian rules on electronic commerce (Legislative Decree 70/2003).

1.4 The informations contained in these General Conditions of Sale must be considered an integral and essential part of the sales contract stipulated between the parties. The same Conditions must be viewed and accepted before sending the purchase order and they are present on the Website and printable by it and therefore they are reproducible in compliance with the provisions of art. 12.3 ° paragraph of Legislative Decree 70/2003.

1.5 Passion4Dolls may modify the Content of the General Conditions at any time and without notice. The General Terms and Conditions of Sale displayed on the Website when ordering will apply to each individual Purchase Agreement. Any changes to these General Conditions will be considered effective at the time of their publication on the website and will apply only to sales concluded after the publication. The date on which the last revision took place is indicated below the conditions.

1.6 Sales concluded between Passion4Dolls and Customers, through access to the website www. Passion4Dolls.com, are governed by Italian law and, in particular, where applicable, by Legislative Decree September 6, 2005, nr. 206 (Consumer Code), by Legislative Decree April 9, 2003 nr 70 and the further legal provisions applicable to distance contracts.

2. REGISTRATION AND PASSWORD

2.1 For the purchase of products on the Website the Customer must proceed to the registration on the Website, for which he must indicate his personal details, residence, a valid e-mail address, credit cards and in the case of legal persons, the company name, VAT number and Tax Code. You must also indicate the place where the products are to be delivered. It will be your responsibility to keep your personal data updated, correcting any changes to the data entered promptly through the management area of your account.In the event that the Customer does not want to register on the Website, he can, in any case, concludes the purchase procedure, but he will not be able to check the status of his orders and take advantage of discounts and promotions. It is strictly forbidden to enter false and / or invented and / or fictitious data relating to third parties. Passion4Dolls reserves the right to legally pursue any violation and any fraudulent action against it and / or against other consumers. No responsibility can be charged to Passion4Dolls for the issue of incorrect tax documents due to errors in the data provided at the time of registration.

3. NOTIFICATIONS AND COMMUNICATIONS

3.1 By purchasing Passion4Dolls products through the website www.passion4dolls.com, you accept that all notifications and communications relating to orders are made by Passion4Dolls by e-mail and you recognize their validity for the purpose of building of existing relationships

 

4. USE OF THE WEBSITE

4.1 The www.passion4dolls.com website is a telematic site for the sale of silicone and TPE (thermo plastic elastomer) dolls and related accessories in general with the exclusive brand JY-doll, Climax-doll, Qita-doll, Irontech-doll. (hereinafter, Products.)

4.2 Passion4Dolls is committed to constantly updating the contents on the website www.passion4dolls.com and to providing users with accurate and updated informations. The Website should not be considered or used as the only basis for making decisions without consulting primary sources of information. Any reliance on the material or on informations on this website is on your personal responsibility.

4.3 All the Products offered are illustrated in detail on the Website, within the respective sections, divided by Product categories

4.4 The visual representation of the Products on the website, where available, has indicative value and normally corresponds to the photographic image of the Products themselves and it has the only purpose of presenting them for sale, without any guarantee or commitment by Passion4Dolls about the exact correspondence the image portrayed on the Website with the real Product; with particular regard to its actual sizes and / or the chromatic aspects of the Products and / or of packaging.

5. ORDERS

5.1 All orders sent through the website www.passion4dolls.com must be complete in all their parts and must contain the elements necessary for the exact identification of the person making the order (Customer), the products ordered and the place where delivery will take place

5.2 The purchase order forwarded and confirmed to Passion4Dolls through the website www.passion4dolls.com is valid as an irrevocable contract proposal. Until confirmation by the Customer, orders may be corrected, modified or deleted. Once confirmed to the system, the orders can no longer be modified or blocked and will therefore be fully binding on the Customer. Therefore it is Customer’s responsibility to check their correctness before confirming it. The order confirmation from Passion4Dolls will be sent to the email address indicated at the time of registration, within two working days of submitting your order; this confirmation will contain the order data and will count as acceptance of the contractual proposal.The contract is considered concluded when the order confirmation is sent to the email address indicated during registration.

5.3 Passion4Dolls reserves the right to accept orders within the limits of stock availability

5.4 Passion4Dolls will not accept orders that are incomplete or not duly completed or that do not show the minimum quantities required or that exceed the maximum quantities provided.

5.5 Passion4Dolls, moreover, reserves the right not to accept orders from Customers who have previously refused unjustifiably to collect the products ordered or have not paid in full what is due in relation to previous deliveries. Furthermore, at the sole discretion and unquestionable judgment of passion4dolls, it reserves the right to refuse any order placed. If it make changes or cancel an order, it may try to notify by email provided when entering your personal data.

5.6 It is possible that occasional unavailability of the Products offered may occur, in this case, if the Products chosen by the Customer are not, in whole or in part, available, the order will be sent with the products available

5.7 Once the ordering process has started, the order cannot be cancelled. However, if production has not started, we can cancel and refund the order. A penalty of 20% of the total cost will be retained.

5.8 Customer data are processed by Passio4Dolls in accordance with current legislation on the protection of personal data, as specified in the information contained in the specifically dedicated section, called “Privacy Policy”.

6. PRODUCTS

6.1 The images of the products on the website www.passion4dolls.com are the property of the respective brands and are to be considered purely illustrative and non-binding.

6.2 Passion4Dolls does not assume any responsibility on the part of producers, for any changes on the product, packaging and labelling.

6.3 The products are not supplied on trial; so you will be responsible for the choice of the products ordered and their correspondence to your needs.

7. PRICES

7.1 The prices of the products are those specifically indicated for each type of product on this website at the time the order is sent. The prices will be clearly indicated in the summary of your order, which you must confirm before final sending. All prices are inclusive of VAT.

7.2 There are no shipping costs.

7.3 Prices do not include customs duties, for countries outside the European Union and U.S.A. The buyer outside these countries may have to pay the customs duties once the goods have arrived in the country of destination.

7.4 Passion4Dolls reserves the right to cancel an order in case of an obvious error in the calculation system or in the data. In this case, Passion4Dolls will promptly notify you to the e-mail address or telephone number indicated at the time of registration, refunding what has already been paid.

 

8. COSTS, TIME AND TERMS OF DELIVERY

8.1 For the shipment of goods purchased on the Website, Passion4Dolls uses the services provided by third parties by courier companies, and the delivery times will vary according to the destination. The terms indicated at the time of the purchase order are however indicative. Passion4Dolls undertakes to deliver the goods without undue delay and in any case, no later than 30 days after the conclusion of the contract.

8.2 The ordered Products will be sent to the postal address specified by the Customer. Upon delivery of the Products by Passion4Dolls to the appointed courier, an e-mail confirming the shipment will be sent to the Customer. Before carrying out the shipment, Passion4Dolls reserves the right to wait for confirmation of the data requested in the post-sales mail in case they are incomplete and / or incorrect.

8.3 No liability for any reason can be charged by the Customer to Passion4Dolls in the event of delay in processing the order or delivery of the Products covered by the Purchase Agreements.

8.4 Passion4Dolls will deliver the purchased products to the address you have indicated at the time of registration and confirmed at the time the order is sent. It is possible, however, that deliveries may be delayed in periods of greatest demand, in case of adverse weather conditions or in case of immediate unavailability of the product in stock. Delivery times depend exclusively on the Courier and may vary depending on the location, the volume of the goods and the climatic conditions.

8.5 The passage of risks in terms of flaws and defects occurs when the product is delivered by Passio4Dolls to the shipper / courier appointed from time to time

8.6 In any case Passion4Dolls will not be responsible for delays or non-deliveries attributable to the Courier or in any case caused by circumstances beyond its control.

9. CUSTOMER’S ABSCENCE AT DELIVERY

9.1 To avoid unpleasant delays or inconveniences, choose for delivery an address where there is always a person during office hours. In case you are absent at the time of delivery at the place indicated, the courier will send an email notice and will attempt a new delivery. In case of impossibility to execute the new delivery for absence of the recipient, Customer Service will attempt to contact the Customer to schedule a further delivery. In the event that the Customer Service is unable to contact the Customer for the next 10 days or in the event of further impossibility of delivery due to the absence of the recipient, the Products covered by the order will be returned to Passion4Dolls

9.2 After 30 (thirty) days from the date on which the Products covered by the order have been sent back to Passion4Dolls due to the impossibility of carrying out the delivery, the contract will be considered terminated and the purchase order canceled pursuant to art. 1456 of the Italian Civil Code. Passion4Dolls will refund the amount paid by the Customer, net of the costs of returning the Products and the costs of keeping them at the branch of the courier appointed for delivery. In this case, Passion4Dolls may withhold the shipping costs from what you have already paid, and, within 30 days, will refund the difference.

9.3 The termination of the contract and the refund amount will be communicated by e-mail. The refund amount will be credited to the payment method used by the Customer for the purchase. In the event that, before the end of the 30 days, the Customer asks to receive the purchased Products again, Passion4Dolls will proceed to the new delivery, charging, in addition to the costs of the same, the costs of returning the Products to Passion4Dolls and the storage costs.

9.4 Upon delivery of the Products by the courier appointed by Passion4Dolls, the Customer is required to scrupulously check:

1. a) That the anti-burglary label is intact and the packaging is not damaged or otherwise altered.
2. b) That the number of pieces delivered corresponds to what is indicated in the transport document.

9.5 Any damage to the anti-burglary label, to the packaging and to the Products or the mismatch in the number of pieces / packages or indications must be immediately reported by the Customer to the shipper and subsequently he can contact Passion4Dolls through the Customer Service, specifying the order for which such problems occurred. These reports will be taken into consideration exclusively, with the help of photographic evidence.

10. PAYMENT TERMS

10.1 PAYPAL

To ensure maximum security for its customers, Passion4Dolls relies on the experience of PayPal company of the eBay group, for the management of transactions. Paypal represents one of the first escrow services, companies specialized in payments for e-commerce. Payment security is guaranteed by PayPal and the transaction takes place on a secure server. During the payment you will be temporarily transferred to the PayPal site for the compilation of sensitive data in complete safety. On the PayPal site you can make payment in two ways:

1. a) Credit card: Visa, Visa Electron, American Express, Mastercard or prepaid card (PostePay). No registration required.
2. b) PayPal (the opening of a PayPal account is required). By filling in the appropriate space on the Website, you will authorize Passio4Dolls to charge the total amount of the order, including shipping costs, to your credit card

At the end of the payment, you will be transferred again to the website www.passion4dolls.com for the final confirmation of the order. A confirmation e-mail from PayPal will be sent to each transaction made through this method.

In case of cancellation of the order, the amount will be refunded to the customer’s PayPal account.

10.2 BANK TRANSFER

If you choose to pay by bank transfer, the order completion procedure will lead the transaction to a successful conclusion, without further steps.

To pay the bank transfer it will be necessary to follow this procedure:

The bank transfer must be made within 3 working days from the order; we also ask you to indicate us in the purpose of the bank transfer: the order number, the date of the order and your name and surname, in order to help us check the amounts.

Your order will be processed upon we receive the bank transfer amount or upon we receive the confirmation that the payment has been made (C.R.O., or receipt by fax or email).

At the expected delivery times it will therefore be necessary to add the time within which we receive the documentation certifying the payment.

11. PROMOTIONS AND GIFTS

11.1 The promotions on the website www.passion4dolls.com, are valid until stocks last and within the purchase limits indicated.

11.2 Promotional products may be delivered in promotional packages other than those published on the website

11.3 No replacement or return is possible in relation to any products received for free.

12. NON-COMPLIANCE OF PRODUCTS, DEFECTED PRODUCTS AND RIGHT TO WITHDRAWL

12.1 The Products offered on the Website comply with national and European Community legislation. The images and colors of the Products published on the website may differ from the real ones due to the local settings of the systems and / or tools used for their display.

12.2 In the event of a lack of conformity of the Products purchased as reguards the description published on the Website and in the event of a faulty or defective Product, the Customer has the right to a partial or total refund of the non-compliant product, after sending, by form present in the Customer Service section, photographs that highlight the damage or non-compliance of the Product.

12.3 This will be followed by communication from the Passion4Dolls staff with indication about the refund method that could take place, at the discretion of the Customer, also through discount vouchers on the next purchase higher than the value of the goods to be refunded, excluding any further liability of Passion4Dolls, for any reason.

12.4 In any case, the provisions on the legal guarantee of conformity of the goods, provided for by the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102-135) are reserved.

12.5 If the goods were damaged, or the order was incorrect, the customer will be reimbursed as required by current legislation. The law (Legislative Decree No. 21/14) establishes a useful term for making use of the right of withdrawal quantified in 14 days from the receipt of the goods. 12.6 The right of withdrawal does not apply to orders and goods made on specific customer request (for products agreed in advance with the customer and made specifically).

12.7 The integrity of the returned goods and of the original packaging is an essential condition for exercising the right of withdrawal, for goods sealed for hygiene reasons, they cannot be returned if already opened by the consumer.

12.8 In the event of replacement due to defect or damage Passion4Dolls will check the items that have been returned as damaged or defective. In the event that no defect is found, we reserve the right to charge you for the shipping costs and the cost of the item itself.

12.9 If the withdrawal and return of the goods will be made according to the above indicated methods, Passion4Dolls will refund you what you have paid in relation to the processed order, within the next 5 working days.

 

13. APPLICABLE LAW AND JURISDICTION

13.1 The contracts stipulated through this website are governed by Italian law.

13.2 For any controversy relating to the interpretation, execution, validity or effectiveness of these General Conditions of Sale and any contract entered into with Customers, the Court of Catania will have exclusive jurisdiction.
